Terms and Conditions

These terms apply to the use of www.tulipframe.cc and to requests sent through it. Please read them before you send a request. The specific agreement for a photoshoot is set out in your written quote.

Who we are

What TulipFrame does

TulipFrame is an intermediary: we match people who want a photoshoot with independent photographers in the Netherlands. We don't take the photographs ourselves. The photographer who carries out your shoot is responsible for the photography itself.

Requests are free and non-binding

  • Sending a request through our website is free.
  • A request does not commit you to anything. It asks us to find a suitable photographer and send you a quote.
  • We will try to find a match for every request, but we can't guarantee that a photographer is available for every date, location or budget.

Prices

The prices on our website are starting prices ("from €X"). They are indicative, not offers. Your actual price depends on the photographer, duration, location, number of people, date and your specific requirements, and is stated in your quote. Prices for consumers include VAT where applicable.

Quotes and the photography agreement

The quote you receive sets out the terms of the photography agreement, including:

  • who the agreement is with;
  • the price and what it includes (duration, number of edited photos, travel costs, extras);
  • how and when to pay;
  • delivery time and how the photos are delivered;
  • cancellation and rescheduling terms, including what happens if the weather makes the shoot impossible;
  • how you may use the photos.

An agreement is made only when you accept the quote. If anything in the quote conflicts with these general terms, the quote takes precedence.

Your responsibilities

  • Give correct information in your request, and tell us or the photographer about changes as soon as possible.
  • Be on time at the agreed location. If you are late, the session may end at the agreed time.
  • Make sure you have permission where needed, for example from a venue, or from the people you want photographed.
  • Don't use our website for spam, abuse or unlawful purposes.

Unless your quote says otherwise, the photographer keeps the copyright to the photos, and you receive the right to use them for personal, non-commercial purposes. Commercial use requires a licence agreed in the quote. Photographers may ask your permission before using photos of you in their portfolio; you are not obliged to give it.

Consumer rights

If you are a consumer, you keep all the rights that Dutch and European consumer law gives you, and nothing in these terms limits them. A photoshoot booked for a specific date is a leisure service for a specific date, for which the statutory 14-day withdrawal right generally does not apply; your quote sets out the cancellation terms instead.

Liability

The photographers we match you with are independent professionals, and we are not liable for how they carry out the shoot, except where we are responsible under the law. Our liability for our own services — matching and handling your request — is limited to direct damage and to the amount you paid to TulipFrame for the booking concerned, except in the case of intent or gross negligence on our part, or where the law does not allow a limitation.

We are not liable for damage caused by circumstances beyond our control (force majeure), such as extreme weather, illness, transport disruption or government measures.

The website

We try to keep the information on our website accurate and up to date, including information about locations, opening times and rules, but these can change. Please check important details with the venue before you rely on them. We may change or suspend the website at any time.

Photographs of cities, locations and types of shoot are largely stock photographs from Unsplash, credited to their photographers on each image and on our photo credits page. They illustrate places and occasions; they are not the work of a specific photographer you book through us. A photographer's own work is shown on their profile and shared with your quote.

Complaints

If you are not satisfied, contact us at hello@tulipframe.nl. We aim to respond within 14 days. Complaints about a shoot are best raised as soon as possible after it, so we can look into them with the photographer.

Applicable law

These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, unless mandatory consumer law gives you the right to go to a court in your own country.

Changes

We may change these terms. The version that applies to your request is the one in force when you send it. The date of the latest version is shown on this page.
